Trial after breath test refused
A SHEPTON Mallet man accused of an offence of failing to comply with a breath test has been ordered to stand trial before Somerset Magistrates.
Morgan Ashton, aged 22, of Rose Court, appeared before the court at Yeovil and pleaded not guilty to failing to provide a specimen of breath for analysis on September 25.
Defending solicitor Jeffrey Bannister said that there was confusion on his client's part as to whether he was going to be offered an alternative means of providing a sample after being taken to the police station.
A pre-trial review was carried out by Somerset Magistrates and the case was adjourned until Friday, January 10, when the defendant must return to the court to stand trial.
