One of the biggest concerns clients face when faced with separation is going to court and running up huge legal bills.  However, there is alot of work you can do yourself to reduce legal costs, and you may not need to go to Court at all.

The divorce just ends the marraige, but it does not deal with the finances.  The problems are ususally about these and not the divorce itself.  You can start the divorce proceedings and have them going on in the background without having to go to Court.  We can help you draft the necessary paperwork and you can deal personally with the divorce to limit your legal costs.  It normally takes about six months to finish a divorce and  you can use that time to sort out the financial situation.

The main reasons relationships breakdown is lack of communication so of course it may well be hard for you to discuss the financial situation directly with your spouse.  There are ways to help you with this.  One of the ways is for the two of you attend mediation together.  Th is is not about saving the marriage, but about sorting out the finances with the help of a trained mediator.

Another way to deal with matters is for you and your spouse to both see lawyers who are collaboratively trained.  The collaborative process involves you, your spouse and both your lawyers sitting down together to work out the issues and the ways to resolve them.  You are fully involved in the process and it is a very civilised way to reach agreement.

Alternatively, you can instruct your solicitors to try and reach agreement between themselves, acting of course on your instructions.  If all else fails, an applicaiton can be made to the Court to resolve financial matters.  The Court process has a series of steps, the most important of w hich is a dispute resolution hearing where the Judge will try and assist in reaching a settlement.  All of this is set up to try and avoid you and your spouse having to go to Court to give evidence against each other.

The more work you can do to provide the full financial disclose which is required, such as gather information about your pensions and your business, the lower your legal costs.
